COLGATE-PALMOLIVE COMPANY GLOBAL PRIVACY POLICY

Colgate-Palmolive Company and its subsidiaries and affiliates (“Colgate” or “we” or “our” or “us”) respect your privacy and value the relationship we have with you. Therefore, we handle your personal data responsibly, and we want you to be familiar with how we collect, use, disclose, and protect your data. This Privacy Policy describes our practices in connection with your data and your related rights.

This Privacy Policy also describes our practices in connection with data that we collect about professionals such as dental professionals, estheticians, veterinary professionals and students, and health care experts (“Professionals”), in order to provide them with professionally-oriented services (“Professional Services”).

In this Privacy Policy, we refer to our Websites, Apps, Devices, Social Media Pages, email messages, advertisements, product recommendations, offline activities and Professional Services collectively as the “Services.” We may provide additional notices in connection with certain Services or offerings.

WHAT IS PERSONAL DATA?

Personal Data is data that identifies, describes, or is reasonably capable of being associated with or linked with you. This includes information like name and email address, and can also include other identifiers as explained below.

WHAT PERSONAL DATA WE COLLECT

When you interact with our Services, we may collect the following categories of Personal Data. All of these categories may not apply to your interaction with us, but this policy provides an overview of categories and possible interactions.

  • Identifiers

    Such as name, postal address, email address, Internet Protocol (IP) address, device identifiers, and social media username / handle and government identifiers and device information

  • Internet / Network Activity

    Such as your interaction with our sites, apps, advertisements, or other media

  • Commercial and Payment Information

    Such as products or services purchased or considered and credit or debit card information

  • Location Data

    Such as general information indicating your location and information that permits us to approximate or determine your location

  • User Generated Content

    Such as your communications with us and content you provide through social media, comments, testimonials, feedback, reviews and survey responses

  • Audio / Visual Information

    Such as photographs, images and videos that you share with us, voice or call recordings such as those recorded during interactions with Consumer Affairs for quality assurance and analytics purposes, and closed-circuit television video recordings at our facilities.

  • Demographics

    Such as age, gender, marital status and other household information

  • Physical Characteristics

    Such as skin type, tooth color, eye color, or other profile information that you share with us

  • Health Information

    Such as health objectives, medical conditions, or other information you provide in connection with your use of our Services

  • Inferences

    Such as inferences drawn from the information described above to assess interest in products and Services

  • Sensitive Personal Information

    We only collect sensitive personal information with your consent and only for the uses which you have authorized.

HOW WE COLLECT PERSONAL DATA

We and authorized third-party service providers working on our behalf collect Personal Data in a variety of ways, including:

  • Through the Services

    We collect Personal Data through the Services, for example, when you sign up for a newsletter, register an account, create a profile, interact with our Services through applications, chatbots, surveys, or other features, or make a purchase

  • Offline

    We collect Personal Data from you offline, for example:

    • When you place an order over the phone, contact Consumer Affairs or reach out to us with any other inquiry;
    • When you visit our booth at a tradeshow or visit our facilities;
    • When you participate in our programs or activities or provide data at industry events;
    • When you participate in an offline sweepstakes or promotion;
    • When you or someone on your behalf reports an adverse event with respect to one of our products.
  • Through Business Partners

    When we collaborate with businesses and other partners, we may obtain information about you and your interactions with these businesses and other partners.

  • From Social Media Platforms

    If you connect your social media account to any account offered by us, you will share certain Personal Data from your social media account with us, such as your name, email address, photos, list of social media contacts, and any other data that may be (or that you make) accessible to us.

  • From Other Sources

    We receive your Personal Data from other sources, for example:

    • Publicly available databases and sources;
    • Data companies;
    • Joint marketing partners;
    • Third parties who report adverse events regarding a product to us.
  • Through Cookies and Other Technologies

    When you interact with our Services, advertisements, and open or click the emails we send, we automatically collect certain information using cookies, pixels, web beacons, and other tracking technologies. 

    • Through your browser or device: Certain data is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Services (such as the App) you are using.

    • Through your use of an App: When you download and use an App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what data and files have been downloaded to the App based on your device number.

    • Using cookies: Cookies are pieces of data stored directly on the computer that you are using. Cookies allow us to collect data such as browser type, time spent on the Services, pages visited, referring websites, and other traffic data. For more information about cookies, please see the Cookie Section below.

      • If you do not want data collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting a particular cookie (or cookies) from a particular website. You may also wish to refer to http://www.allaboutcookies.org. If, however, you do not accept cookies, you may experience some inconvenience in your use of the Services. You also may not receive advertising or other offers from us that are relevant to your interests and needs.

    • Using pixel tags, and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of users of the Services (including email recipients), measure the performance of our marketing campaigns, and compile statistics about usage of the Services and response rates.

    • Analytics: We use Google Analytics, among other similar technologies, which uses cookies and similar technologies to collect and analyze data about use of the Services and report on activities and trends. This service may also collect data regarding the use of other websites, apps, and online resources.     • IP Address: Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications, and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, and administering the Services. We may also derive your approximate location from your IP address.

    Physical Location: We may collect the physical location of your device by, for example, using satellite, cell phone tower, or Wi-Fi signals. We may use your device’s physical location to provide you with personalized location-based services and content. In some instances, you may be permitted to allow or deny such uses of your device’s location, but, if you do, we may not be able to provide you with the applicable personalized services and content.

  • More About Cookies

    Cookies are small files that are downloaded to your computer or mobile device when you visit a website. Generally, cookies are then sent back to the originating website on each subsequent visit, or to another website that recognizes that cookie. Cookies are useful because they allow a website to recognize a user's device. A cookie assigns a unique numerical identifier to your web browser, and may enable us to recognize you as the same user who was at our website in the past and relate your use of the website to other information about you.

     

    Cookies perform many different functions, such as letting you navigate between pages efficiently, remembering your preferences, and generally improving the user experience. They can also help to ensure that advertisements you see online are more relevant to you and your interests.

     

    Our websites use several types of cookies, including 'essential website cookies', 'functionality cookies', 'analytics cookies' and 'advertising cookies':

     

    • Essential website cookies (from Colgate-Palmolive): These cookies are essential to enable you to move around our websites and use their features. These cookies don't gather information about you that could be used for marketing or remembering where you have been on our site. These cookies are often session-specific, expiring after your visit to the website (session) has ended. These cookies cannot be disabled.

     

    • Functionality cookies (from Colgate-Palmolive): These cookies allow our websites to remember choices you make (such as your user name, language or region you are in) and provide enhanced, more personal features. The information these cookies collect may be anonymized, and they cannot track your browsing activity on other websites. 

     

    • Analytics cookies (from third parties): These cookies are used to collect information about how visitors use our sites, including the number of visitors, the websites that referred them to our websites and the pages that they visited on our websites. We use this information to compile reports and to help us improve our websites, for example, to understand how visitors use our site and by ensuring that users find what they are looking for easily. These cookies typically stay on your computer until you delete them as described below.

     

    • Advertising cookies (from third parties): These cookies are used to collect data about the websites and individual pages that users visit both on and off our websites (which might indicate, for example, your interests and other attributes). These cookies may be used for personalized advertising. They are typically used to deliver advertisements that are more relevant to you and your interests, with personalization, and to help measure the effectiveness of an advertising campaign. This information is shared with other organizations such as advertisers and our partners, who might use it with information about how you use other websites, including to identify shared interests and behaviors across groups of users who visit our (and other) websites. These cookies typically stay on your computer until you delete them as described below.

     

    Managing and Deleting Cookies:

    We understand that you may want to control which cookies are set as part of your visit to our sites. You can manage the use of cookies on your devices by using our Cookie preferences tool and/or functions available on most internet browsers. Cookies can also be deleted from your device’s storage medium at any time.

    If you choose to delete or refuse cookies, please bear in mind that you may not be able to use the full functionality of our websites and any communications you receive from us may be less relevant to you than they might otherwise have been.

    If you have disabled one or more cookies, we may still use information collected from cookies before your disabled preference was set. However, we will stop using the disabled cookie to collect any further information.

     

CONNECTED DEVICES

We also collect, use, and disclose Personal Data in connection with our Connected Health Devices, including the hum by Colgate and Colgate Connect E1 Smart Toothbrush and Colgate Whitening LED kit (the “Devices”) in several ways:

  • Through the App

    Such as when you provide your email address or a profile photo in connection with account creation. When you download and use the App, we will collect your toothbrush serial number, as well as data about your use of the App, such as games and other features used and the dates and times of your interactions with the App.

    For example, when using connected toothbrushes, we collect data about your brushing, such as time spent brushing, frequency of brushing, areas of the mouth brushed, and position of the toothbrush (including but not limited to when you brush in connection with a game) to understand how the App is used, including which features and interactions help improve brushing technique, and to design new features and games.

  • Through the Site

    Such as when you purchase products, contact us via chat or email, or subscribe to our newsletter.

  • Through Your Device

    Certain data is collected automatically through your device or browser, such as a device ID, your screen resolution, operating system, device manufacturer and model, language, default country setting, and Internet browser type and version. We use this data to ensure that the Services function properly. We use the device ID to send you push notifications, subject to your consent (or parental consent) where required by applicable law.

  • From Other Sources

    Such as your insurance company or dentist, with your consent.

The technology used to evaluate your tooth brushing, which includes algorithms that analyze your face and your brushing technique, is run in real time on your device (and thus is not collected or captured by Colgate). We do not collect this information from your device or access it on your device, nor do we use this technology to identify you.

We use Personal Data to provide the Services’ functionality to you, such as, if you use our Apps, providing you with a weekly review of your activity, to better understand you and provide content, information, and offers tailored to your interests, and to analyze use of the Services so that we can improve them. For more information on how we use Personal Data, please see below.

HOW WE USE PERSONAL DATA

We and authorized third-party service providers working on our behalf use Personal Data for legitimate business purposes when we interact with consumers, the public, Professionals, and our retail customers. Below we provide an overview of our uses of Personal Data.

  • INTERACTING WITH CONSUMERS AND THE PUBLIC

  • Providing the Services and fulfilling your requests

    • To provide the Services to you, such as arranging access to an account you set up with us.
    • To respond to your inquiries and fulfill your requests, when you contact us via one of our online contact forms, by telephone or otherwise, for example, when you send us questions, suggestions, compliments, or complaints.
    • To the extent you elect to share personal information, for instance about your skin or oral health, we will use that information consistent with the notice we provide to you at that time and with your consent.
    • To send administrative information to you, such as changes to our terms, conditions, and policies.
    • To allow you to send messages to another person, through referrals or “send to a friend” features.
    • To facilitate social sharing functionality, if you choose to use such functionality.
    • To fulfill your purchases or other transactions.
    • To provide you with customer service.
  • Providing you with information about products and other marketing materials across Colgate’s Family of Brands

    To send you marketing-related emails, text messages, push notifications, and other communications with information about our services, products, promotions, tips, and events across Colgate’s Family of Brands, along with other news about us.

  • Providing personalized services and conducting business reporting

    • To analyze or predict your preferences in order to prepare aggregated trend reports on how our digital content is used.
    • To better understand your preferences, so that we can personalize our interactions with you and provide you with information and/or offers across Colgate’s Family of Brands tailored to your interests.
    • To measure the effectiveness of our advertising. 
    • To better understand your interests so that we can deliver content via our Services that we believe will be relevant and interesting to you.
  • Allowing you to participate in sweepstakes, contests, or other promotions

    We may offer you the opportunity to participate in a sweepstakes, contest, or other promotion. Some of these promotions have additional rules containing information about how we will use and disclose your Personal Data.

  • Allowing you to participate in the Colgate Bright Smiles, Bright Futures® Program

    • To administer the program.
    • To ensure that samples are being used appropriately.
  • INTERACTING WITH PROFESSIONALS, RETAIL CUSTOMERS, AND BUSINESS PARTNERS

Information we collect from Professionals, Retail Customers, Business Partners includes preferred language; professional biography and education; webstore account number and ID; data regarding your licensures, specialties, affiliations, publications, credentials, and other achievements; and data regarding your use and purchase of our products, including credit card information as applicable, your interactions with us, and services for those to whom you provide care. Below we provide an overview of our uses of Professionals’ Personal Data.

  • Fulfilling requests related to our Professional Services

    • To pay for services or reimburse expenses.
    • To assist in planning trips related to our business or conferences.
    • To provide you with the products and samples you have requested.
    • To identify and engage with Professionals as scientific experts or professional leaders.
    • To enforce the contractual terms and conditions governing our relationship with Professionals.
  • Engaging with Professionals

    • To interact with you based on your professional expertise and opinion by digital or other means.
    • To involve you in programs/panels of professionals. 
    • To reach out to you for your professional expertise, for example, in the context of surveys relating to products or services offered by us or an affiliate. 
    • To collaborate with you on events, publications, or advisory meetings 
    • To seek your views on products and services promoted by us, an affiliate, or business partner for development and improvement purposes.
  • Allowing Professionals to participate in special programs, events, or promotions

    In these cases, we may use Professionals’ Personal Data in additional ways as disclosed as part of these special programs, activities, events, or promotions.

  • Allowing Professionals to create a webstore

    We give Professionals the opportunity to create a webstore to help them provide optimal patient services and convenient access to our products.

  • OTHER USES AND DISCLOSURES

  • Accomplishing our business purposes

    • To comply with applicable law and regulations.
    • To cooperate with public and government authorities.
    • To cooperate with law enforcement.
    • In connection with a sale, reorganization, joint venture or other business transaction, where we have a legitimate interest in disclosing or transferring your Personal Data to a third party.
    • For other legal reasons, such as enforcing our terms and conditions or protecting our rights, privacy, safety, or property, and/or that of our subsidiaries or affiliates, you, or others.
    • For audits, to verify that our internal processes function as intended and are compliant with legal, regulatory, or contractual requirements.
    • For fraud and security monitoring purposes, for example, to detect and prevent cyberattacks or attempts to commit identity theft.
    • For aggregating, de-identifying, and anonymizing Personal Data so that it will no longer be considered Personal Data because it no longer identifies any individual. We do so to generate other data for our use, which we may use and disclose for any purpose.
    • For developing new products and services.
    • For enhancing, improving, or modifying our current products and services.
    • To manage and report adverse event reporting relating to our products.
    • For identifying usage trends, for example, understanding which parts of our Services are of most interest to users.
    • For determining the effectiveness of our promotional campaigns, so that we can adapt our campaigns to the needs and interests of our users.
    • For operating and expanding our business activities.
    • To comply with anti-corruption and transparency obligations.
    • To track and respond to concerns and meet our regulatory monitoring and reporting obligations, including those related to product complaints, product/patient safety, and background checks.
    • To better understand how our products and services affect Professionals and those for whom they care.

These uses and disclosures of your personal data can occur outside your country of residence.

We engage in these activities and process your Personal Data to manage our relationship with you, comply with a legal obligation, or provide you with Services / perform a contract with you, where the processing occurs with your consent, or is in our legitimate interest and not overridden by your data protection interests or fundamental rights.

Colgate does not sell or exchange your Personal Data for monetary compensation. See section below on “Your Choices Regarding Disclosure of Personal Data” for more information about how Colgate may disclose your Personal Data to third parties and the choices you have to restrict or stop such disclosure.

  • Incentives for Personal Data

We may offer programs with financial incentives or service differences such as a bonus card, discount or a coupon to consumers or Professionals in exchange for their Personal Data.  We may collect Personal Data such as your name, email address, preferences, experiences, and engagement with Colgate (“Consumer Data”).  If you participate in those programs, we will obtain your consent, which can be revoked at any time. Please note revocation of consent may affect your eligibility to participate in those programs.  We estimate that the value of the Consumer Data is the value of the benefit we offer to you in connection with the promotion or survey, which is reasonably related to the costs associated with offering such benefit.

HOW WE DISCLOSE PERSONAL DATA

  • We disclose Personal Data:

    • To our subsidiaries, affiliates, and brands for the purposes described in this Privacy Policy, including providing you with personalized marketing communications, product offers and promotions,  advertisements, and other curated content across Colgate’s Family of Brands.

      • The Colgate-Palmolive subsidiary or affiliate that has collected your Personal Data will be responsible for Personal Data about you that is transferred and used.

    • To our third-party service providers, to facilitate services they provide to us.

      • These can include providers of services such as website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services.

    • To third parties, to permit them to send you marketing communications, consistent with your choices.

    • To third-party sponsors of sweepstakes, contests, and similar promotions, consistent with your choices.

    • In connection with providing our Professional Services, to other companies with which we collaborate regarding particular products or services.

      • These can include our co-promotion partners for products that we jointly develop and/or market.

    • By using the Services, you may also elect to disclose Personal Data.

      • You may disclose Personal Data on message boards, chat, profile pages, blogs, and other services to which you are able to post data and content (including, without limitation, our Social Media Pages). Please note that any Personal Data you post or disclose through these services will become public and may be available to other users and the general public.

    • You may also disclose Personal Data through your social sharing activity. When you connect your Services account with your social media account, you may share data with your friends associated with your social media account, with other users, and with your social media account provider. By doing so, you authorize us to facilitate this sharing of data, and you understand that the use of shared data will be governed by the social media provider’s privacy policy.
    • We engage in these activities to manage our relationship with you, comply with a legal obligation, or provide you with Services / perform a contract with you, where the processing is in our legitimate interest and not overridden by your data protection interests or fundamental rights, or with your consent.
    • Our Advertising: We use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services.
    • Such advertisements are served based on your access to and use of our Services and other websites or online services on any of your devices, as well as on data received from third parties. Third-party advertising companies make this possible by placing or recognizing a unique cookie on your browser (including through the use of pixel tags). They also use these technologies, along with data they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. YOUR CHOICES REGARDING DISCLOSURE OF PERSONAL DATA

We give you choices regarding our use and disclosure of your Personal Data for marketing purposes. Residents of certain U.S. states, particularly California, Colorado, Connecticut, Oregon, Texas, Utah, and Virginia may have additional rights as described in the section “California and Other State Privacy Rights” below.
You may opt-out from:

  • Receiving electronic communications from us: If you no longer want to receive marketing-related emails, texts or SMS messages from us, you may opt-out by following the instructions contained in each such message or by contacting Consumer Affairs.
  • Receiving push notifications from us: If you no longer want to receive push notifications, you may stop these notifications through your device settings.
  • Receiving marketing communications related to our Professional Services: If you use our Professional Services and no longer want to receive marketing communications from us, you may opt-out by contacting Consumer Affairs. In your request, please provide your name and address where you no longer wish to be contacted.
  • Our sharing of your Personal Data with subsidiaries or affiliates for their direct marketing purposes: If you would prefer that we discontinue sharing your Personal Data on a going-forward basis with our subsidiaries or affiliates for their direct marketing purposes, you may opt-out of this sharing by contacting Consumer Affairs.
  • Our sharing of your Personal Data with unaffiliated third parties for their direct marketing or analytical purposes: If you would prefer that we discontinue sharing your Personal Data on a going-forward basis with unaffiliated third parties for their direct marketing purposes, you may opt-out of this sharing by contacting Consumer Affairs.

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related communications from us, we may still send you important administrative or transactional messages as applicable, from which you cannot opt out.

 

HOW WE PROTECT YOUR PERSONAL DATA

We use reasonable organizational, technical, and administrative measures to protect Personal Data within our organization and endeavor to prevent unauthorized access. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us by contacting Consumer Affairs.

HOW LONG WE RETAIN YOUR DATA

We retain Personal Data for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law and Company policy.

The criteria used to determine our retention periods include:

  • The length of time we provide the Services to you (for example, for as long as you have an account with us or keep using the Services);
  • The length of time we have an ongoing relationship with you;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); and
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, government investigations or regulatory considerations).

 

SENSITIVE PERSONAL DATA

Unless we specifically request it in connection with the Services, we ask that you not send us, and you not disclose, any Sensitive Personal Data (e.g., social security numbers, data related to racial or ethnic origin, political opinions, religion or other beliefs, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Services or otherwise to us.

MINORS / CHILDREN’S PRIVACY - NOTE TO PARENTS AND CAREGIVERS

Unless otherwise indicated, the Services are not directed to minors as defined by applicable law. For example, in the US, minors are individuals under the age of 13, and in the EEA, we honor Member State laws, and we do not knowingly collect Personal Data from minors. If you provide us with Personal Data of minors, you represent that you have the appropriate authority to do so and that you can demonstrate such authority to us upon request. We do not have actual knowledge about selling or sharing Personal Data of consumers under the age of 16.

We care about the privacy of children. We recognize that children’s use of the Internet and email raises special concerns regarding the privacy and security of Personal Data. We encourage all parents and caregivers to check and monitor their children’s online activities.

Your child can enjoy most of the content and activities in our children’s areas without providing any Personal Data to us. For example, https://www.colgate.com/en-us/products/kids provides information about Colgate kids’ products, as well as educational videos that help kids to develop healthy habits. In addition, https://www.colgate.com/en-us/bright-smiles-bright-futures provides oral educational materials designed for teachers, parents and kids, and has fun activities for kids. 

For your child’s enjoyment, we may link to other sites. We are not responsible for those other sites, and we advise you to check the privacy policies on those sites as well.

We sometimes solicit or accept submissions from children, such as artwork entered in a contest, some of which may be posted on our sites. Such submissions may be made offline as well as online. If a child or parent wants us to post a photograph or any other Personal Data of a child, we require a signed parental permission and release form. When children make submissions to us offline, such as by regular mail, we may retain all of the information they submit to us. Unless we receive a signed parental permission form, we screen all offline submissions before they are posted, and strip out and delete any Personal Data they may contain prior to posting them.

In the limited instances where we collect Personal Data from children with a signed parental permission and release form, applicable law may give parents the right to review, correct, update, suppress, restrict and/or delete Personal Data we have collected from their children, or to refuse to permit further collection, use or disclosure of such Personal Data. THIRD PARTY SERVICES

We may use a third-party payment service to process payments made through the Services. If you wish to make a payment through the Services, your Personal Data will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your Personal Data.

This Privacy Policy does not address, and we are not responsible for, the privacy, data, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our subsidiaries or affiliates.

Submitting Requests

If you are a resident of California, Colorado, Connecticut, Oregon, Texas, Utah, or Virginia, subject to the applicable local law in your state, you may submit your requests to opt out, correct, delete, and/or to know/obtain Personal Data we have collected about you by accessing our Consumer Affairs page by clicking here or by contacting our Toll-Free Telephone Number at 1-800-468-6502. 

We will respond to your request in compliance with the requirements of your state’s applicable laws.  Please note that we are only required to honor California requests to know twice in a 12-month period.

Verification of Your Identity

When you exercise these rights and submit a request to us, we will verify your identity by asking you to provide us with additional information such as your email address, or order numbers of previous orders of our products and services.  We also may use a third-party verification provider to verify your identity.

Appeal

Residents of Colorado, Connecticut, Oregon, Texas and Virginia may appeal a decision we have made regarding their requests by calling us at 1-800-468-6502 or by using the form available on our website.  We will respond to appeals from Virginia and Connecticut residents within 60 days.  We will respond to appeals from Colorado residents within 45 days.

Non-Discrimination

If you make a request under the applicable California, Colorado, Connecticut, Oregon, Texas, Utah, or Virginia data privacy laws, we will not discriminate against you in any way.  For example, we will not deny you discounts or other benefits or impose penalties on you, or provide you with or suggest that you will receive a different level or quality of benefits or services.

Automated Decision-Making

We generally do not use automated decision-making technology, as that term is defined by state privacy laws. If we make use of automated decision-making technology, you will be informed through a separate privacy notice.

Authorized Agents

You may permit an authorized agent to submit a request to know or to delete your Personal Data.  If we receive a request on your behalf, we will ask that person to give us proof that you gave that person written permission to make a request for you.  If that person does not provide us with written proof, we will deny their request so that we can protect your Personal Data.

 

JURISDICTION AND CROSS BORDER TRANSFER

Given that we operate internationally, our processing of your Personal Data may involve the international transfer of your Personal Data. Cross-Border Transfers

In principle, we will store domestically the personal information collected and generated during our operations within Mainland China. Emergency Response Plan

Sharing Personal Data

As mentioned in “HOW WE DISCLOSE PERSONAL DATA”, we jointly use your Personal Data with our subsidiaries, affiliates, and brands for the purposes described in “HOW WE USE PERSONAL DATA” in this Privacy Policy. Please note that we may need to retain certain data for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Data provided until after the completion of such purchase or promotion), or to be able to honor opt-out requests.
